Thrift to Save, operated by WomELLE, Corp., is an online thrift store offering a curated selection of quality secondhand clothing, accessories, and related items through our website at https://www.thrifttosave.com and any related services or content (collectively, the “Services”). The following Terms of Use constitute a legally binding agreement (the “Terms”) between you and WomELLE, Corp., its affiliates, and any other services owned or operated by WomELLE, Corp. (collectively, “Thrift to Save,” “we,” “us,” or “our”), governing your access to and use of the Services. You also agree to and accept our Privacy Policy, available at https://www.thrifttosave.com/privacy-policy , which describes how we collect, use, and protect the information you provide to us. The Privacy Policy is incorporated into these Terms by reference.   

By accessing or using the Services, creating an account, making a purchase, or otherwise indicating your assent to these Terms, you agree to be bound by these Terms and represent and warrant that: (1) you have read, understand, and agree to be bound by these Terms; (2) you are of legal age to form a binding contract with us (typically 18); and (3) you have the authority to enter into these Terms, either on behalf of yourself or the entity you represent. If you do not agree to these Terms, you may not access or use the Services or purchase any products.   

These Terms include a mandatory arbitration provision and class action waiver, requiring that disputes between you and Thrift to Save be resolved through binding individual arbitration rather than in court, except as otherwise specified. If you do not agree to these provisions, do not use the Services or purchase our products.   

Changes   

We reserve the right to modify these Terms, our Privacy Policy, and/or the Services at any time, at our sole discretion. Any changes will be effective upon posting the revised Terms on our website at https://www.thrifttosave.com/terms-of-use . At our discretion, we may notify you of significant changes via email to the address associated with your account. Your continued use of the Services after any such changes constitutes your acceptance of the revised Terms. You are responsible for maintaining an accurate and current email address with us (via account settings, if applicable) and for regularly reviewing these Terms to stay informed of updates. If you do not agree with the revised Terms, you must discontinue using the Services.   

Privacy and Data Retention   

Your use of the Services is also governed by our Privacy Policy, available at https://www.thrifttosave.com/privacy-policy , which is incorporated into these Terms by reference. In the event of a conflict between the Privacy Policy and these Terms, these Terms shall prevail. If you do not consent to the collection, use, and storage of your information as outlined in the Privacy Policy, you should not use the Services.   

Thrift to Save retains your information (e.g., account details, purchase history) for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce these Terms. You may request updates or deletion of your personal data by contacting us at contact@thrifttosave.com, and we will take reasonable steps to comply with such requests in accordance with applicable data protection laws. However, we may retain certain information as required by law (e.g., tax records), for legitimate business purposes, or to protect our rights. We also reserve the right to disclose your information if required by law, regulation, legal process, or governmental request.   

License Grant   

Thrift to Save operates the website located at https://www.thrifttosave.com (the “Website”) and related Services, which include data, text, graphics, photographs, images, audio, video, software (including HTML and other scripts), and other content related to our thrift store offerings (collectively, “Information”). This Information is owned or licensed by WomELLE, Corp. and is protected by applicable intellectual property laws. Your access to and use of the Services and Information is expressly conditioned on your compliance with these Terms. Subject to these Terms, we grant you a non-transferable, non-sublicensable, limited, revocable license to access and use the Services and Information solely for your personal, non-commercial use, such as browsing and purchasing secondhand items. Any other use of the Services or Information is strictly prohibited unless expressly authorized by us in writing.   

Account Registration   

To make purchases or access certain features of the Services, you must register an account with Thrift to Save directly or through an authorized third-party service (e.g., Google, Facebook) (each, a “TPS”). By using a TPS, you authorize us to access and store information from your TPS account (e.g., name, email address) and to share your login credentials with the TPS for authentication purposes. You may revoke our access to your TPS account at any time by disconnecting it via your Thrift to Save account settings. The use, storage, and disclosure of your information by a TPS are governed by the TPS’s policies, and Thrift to Save is not responsible for their privacy practices or actions.   

When registering an account, you agree to provide accurate, current, and complete information (e.g., name, email, shipping address) and to update it as necessary. Your account information is subject to our Privacy Policy. You may not create more than one account or use alternate identities to access the Services unless expressly permitted by us. You represent and warrant that: (a) you have not been previously suspended or removed from the Services; (b) you do not maintain multiple accounts; and (c) your registration does not violate any other agreement to which you are a party.   

You are solely responsible for maintaining the confidentiality of your account credentials (e.g., username, password) and for all activities conducted under your account. Notify us immediately at contact@thrifttosave.com if you suspect unauthorized use of your account. We reserve the right to refuse service, terminate accounts, remove content, or cancel orders at our sole discretion, with or without notice.   

No agency, partnership, joint venture, or employment relationship is created between you and Thrift to Save through your use of the Services.   

Purchases and Pricing   

To purchase items through the Services, you must provide a valid payment method (e.g., credit card, PayPal). You are responsible for all fees, taxes, and charges associated with your purchases, including shipping costs. If a payment fails or your account is past due, we may use alternative collection methods, such as charging other payment methods on file, engaging collection agencies, or deducting amounts from linked accounts (where permitted). We may store and update your payment method (e.g., upon expiration) to ensure uninterrupted service and facilitate future purchases. Third-party payment services are subject to their own terms and policies.   

Our inventory of secondhand items and pricing are subject to change without notice. Prices may include surcharges for shipping or handling. We strive to maintain accurate inventory listings, but availability is not guaranteed until your order is confirmed. We reserve the right to limit purchase quantities, correct pricing or typographical errors, and refuse or cancel orders due to such errors or other issues (e.g., suspected fraud), even after an order is placed. If an order is canceled due to an error, we will notify you and refund any payment made.   

Promotions, discounts, or coupons may be offered at our discretion and are subject to additional terms (e.g., expiration dates, U.S.-only eligibility). Only one account per shipping address may be eligible for certain promotions (e.g., new customer discounts). All prices are in U.S. dollars unless otherwise stated. Risk of loss and title for purchased items pass to you upon delivery to the carrier.

Exchange Policy   

Thrift to Save does not accept returns or offer refunds for purchased items. However, we are committed to your satisfaction and offer an exchange option for eligible items under the conditions outlined below. All sales are otherwise final, reflecting the unique, secondhand nature of our thrift store inventory.   

You may request an exchange for eligible items within 7 days of receipt, provided the items are unused, in their original condition (e.g., tags attached, no signs of wear, odor, or damage), and accompanied by proof of purchase. To initiate an exchange, contact us at contact@thrifttosave.com within this 7-day period for instructions and, if applicable, a prepaid return shipping label. Eligible exchanges will be processed for store credit or a replacement item of equal or lesser value (subject to availability), at your choice. If you select a replacement item of greater value, you will be responsible for the price difference. Original shipping costs are non-refundable, and you are responsible for return shipping costs unless the item was defective, damaged during shipping, or incorrectly sent (e.g., wrong size or item).   

Items marked as “final sale” (e.g., heavily discounted or clearance items) are not eligible for exchange. Exchanges not meeting our criteria (e.g., received after 7 days, used, or altered) will be rejected, and the item will be returned to you at your expense or forfeited, at our discretion. We aim to process exchanges within 10 business days of receiving the returned item. For defective, damaged, or misrepresented items, contact us within 7 days of receipt with photos and details of the issue; we will review and, if approved, offer an exchange for store credit or a replacement item, at our discretion.   

Because we do not offer refunds, please carefully review product descriptions, sizes, and conditions before purchasing. All items are secondhand and sold “as is,” and we encourage you to reach out with any questions prior to completing your order. Product Descriptions   

We strive to provide accurate descriptions, images, and details of our secondhand items (e.g., condition, size, color), but we do not warrant that all information is complete, current, or error-free. As our products are pre-owned, they do not carry original manufacturer warranties. We aim to display colors and styles accurately, but variations may occur due to lighting, monitor settings, or item wear. If an item is not as described, your sole remedy is to request an exchange per our Exchange Policy, provided the request is made within 7 days of receipt and meets the eligibility criteria outlined therein. Intellectual Property Rights   

The Services and all Information contained therein (e.g., product listings, images, website design) are protected by copyright, trademark, trade secret, and other intellectual property laws. Except as expressly permitted by these Terms, you may not reproduce, modify, distribute, sell, lease, scrape, or create derivative works from the Services or Information, in whole or in part. You may not use data mining, robots, or similar tools to extract data from the Services, nor may you reverse engineer, decompile, or otherwise attempt to access the source code of the Services. All rights not expressly granted herein are reserved by WomELLE, Corp.   

“Thrift to Save” and associated logos are trademarks of WomELLE, Corp. You may not use these marks, or the look and feel of the Services, without our prior written consent. Brands and logos appearing in product listings are trademarks of their respective owners and do not imply affiliation with or endorsement of Thrift to Save. We are an independent retailer of secondhand goods and are not partnered with these brands.

Your notice must include: (1) your physical or electronic signature; (2) identification of the copyrighted work allegedly infringed; (3) identification of the infringing material and its location on the Services; (4) your contact information; (5) a statement of good-faith belief that the use is unauthorized; and (6) a statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner.   

Feedback and User Content   

If you provide us with ideas, suggestions, or feedback about the Services or products (collectively, “Feedback”), you grant us a worldwide, royalty-free, perpetual, irrevocable license to use, modify, and exploit the Feedback for any purpose (e.g., improving the Services, marketing), without compensation to you. Feedback may include your name, likeness, or voice, which we may use similarly.   

You may submit content to the Services (e.g., reviews, photos, comments) (collectively, “User Content”), provided it is not illegal, obscene, defamatory, threatening, infringing, or otherwise objectionable. You grant us a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, publish, and distribute your User Content worldwide for any purpose (e.g., marketing, display on the Website), without compensation. You represent that you own or control all rights to your User Content and that its use by us will not violate third-party rights. We may, but are not obligated to, monitor, edit, or remove User Content at our discretion.   

Restricted Activities   

You agree not to:    

  • Use the Services for any unlawful purpose;    

  • Impersonate others or provide false information;    

  • Interfere with or disrupt the Services;    

  • Infringe any third-party rights (e.g., privacy, intellectual property);    

  • Use automated tools (e.g., bots, spiders) to access or extract data;    

  • Reverse engineer or modify the Services;    

  • Harass, threaten, or discriminate against others;    

  • Resell, sublicense, or distribute purchased items for commercial purposes without our consent; or    

  • Link to or frame the Services without our consent.   

Limitation of Liability and Disclaimer   

THE SERVICES AND ALL INFORMATION, PRODUCTS, AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS, NOR DO WE WARRANT THE ACCURACY OR COMPLETENESS OF PRODUCT DESCRIPTIONS. TO THE FULLEST EXTENT PERMITTED BY LAW, WOMELLE, CORP., ITS AFFILIATES, OFFICERS, DIRECTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES (E.G., LOST PROFITS, DATA LOSS) ARISING FROM YOUR USE OF THE SERVICES OR PURCHASES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SPECIFIC TRANSACTION GIVING RISE TO THE CLAIM, OR $100, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.   

Dispute Resolution; Binding Arbitration; Class Action Waiver   

Informal Resolution: Before initiating a formal dispute, contact us at contact@thrifttosave.com        
 to attempt resolution. If unresolved within 30 days of your written notice (sent via first-class or registered mail to 1540 S W 8th Street #1119 Boynton Beach, FL 33426), proceed as below.   

Arbitration: Any dispute arising from these Terms or your use of the Services (“Dispute”) will be resolved through binding individual arbitration, not in court, under the Federal Arbitration Act. For claims of $10,000 or less, arbitration will be conducted by FairClaims ( www.fairclaims.com ) per its rules. For claims over $10,000, the American Arbitration Association (AAA) will administer under its Consumer Arbitration Rules ( www.adr.org ). Initiate arbitration by notifying us at 1540 S W 8th Street #1119 Boynton Beach, FL 33426 with a 60-day notice period for settlement discussions. Arbitration may be conducted by telephone, written submissions, or in-person in your county of residence or a mutually agreed location. Each party bears its own costs unless otherwise awarded by the arbitrator. All proceedings are confidential.   

Class Action Waiver: You and Thrift to Save agree to arbitrate Disputes only on an individual basis, waiving any right to participate in class actions, collective proceedings, or jury trials. If any part of this provision is unenforceable, that specific claim must be resolved in court, but the remainder remains binding.   

Termination   

We may suspend or terminate your account or access to the Services at our discretion, with or without notice, for any reason, including suspected violations of these Terms (e.g., fraud, non-payment, misuse). Upon termination, your rights to use the Services cease, but the Arbitration Agreement, intellectual property provisions, and liability limitations survive. You may terminate your account or use of the Services at any time by contacting us at contact@thrifttosave.com or ceasing access.   

General Information   

These Terms are governed by the laws of Florida without regard to conflict of law principles, except for the Arbitration Agreement, governed by the Federal Arbitration Act. If any provision is unenforceable, the remaining provisions remain in effect. Notices to us must be sent to 1540 S W 8th Street #1119 Boynton Beach, FL 33426 via certified mail; notices to you will be sent to your provided email or shipping address. These Terms, with our Privacy Policy and Support Center content, constitute the entire agreement between you and WomELLE, Corp. Any claims must be brought within one year of the event giving rise to the claim, where permitted by law.
